Terms of Service

1. Acceptance of Terms

By accessing or using the LyntCube platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms apply to all users, including property managers, landlords, real estate agents, and organisations using LyntCube.

2. Description of Service

LyntCube provides an AI-powered real estate management platform that automates tenant communications, maintenance workflows, lease management, property analytics, and related operations. The Service integrates with third-party tools including Xero, Slack, AppFolio, Google Workspace, Notion, and Stripe.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials and notify us immediately of any unauthorised access.
• Be at least 18 years old or have the legal authority to enter into a binding contract on behalf of your organisation.
• Not create accounts for fraudulent or harmful purposes.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws, including data protection law.
• Upload or transmit data that infringes third-party rights or contains malicious code.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Use the Service to process data in ways that would violate GDPR, BDSG, or other applicable privacy regulations.
• Resell or sublicense access to the Service without our prior written consent.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. You remain the data controller for personal data you upload to the Service; LyntCube acts as a data processor under a Data Processing Agreement (DPA) available upon request.

6. Intellectual Property

All intellectual property rights in the Service (including the platform, AI models, software, and documentation) remain with LyntCube. You retain ownership of all data and content you upload to the Service. You grant LyntCube a limited, non-exclusive licence to process your data solely to provide and improve the Service as described in our Privacy Policy.

7. Availability and Support

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. Support is provided via email at [email protected].

8. Limitation of Liability

To the maximum extent permitted by law, LyntCube shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount paid by you for the Service in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless LyntCube and its officers, directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

Either party may terminate access to the Service at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for up to 90 days post-termination to allow export, after which it will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. Our registered place of business is Berlin, Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, without prejudice to mandatory consumer protection rights applicable in your country of residence under EU law.
